Mediation
Mediation
Mediation is the process of facilitating discussions between two or more parties at conflict, with a co-operative approach in the hope of reaching a consensual resolution. Mediation should be considered as early as possible after a dispute has arisen as it is likely to be quicker and more cost-effective than the more formal practices. Mediation can be completed within hours rather than weeks or months.
Mediation is a very practical tool and has proven to be highly successful in resolving conflict. This is explained by the fact that it can both resolves issues by developing a mutually satisfying plan and addresses the emotional aspects of conflict
Who is mediation suitable for?
Mediation is suitable for those experiencing problems with a range of issues including but not limited to:
>> Resolving interpersonal conflict (family, friends, partner, colleagues)
>> Dividing property
>> Civil matters
>> Workplace issues such as performance management, bullying and harassment etc.
Our approach to mediation
All sessions are conducted by a Senior Dispute Resolution Practitioner that is accredited by the Attorney General’s Department;
>> Prepared approach, we help thoroughly prepare you for the mediation process;
>> We offer appointments within the same week, and may offer further sessions close together;
>> We use a facilitative, collaborative and interest-based approach;

>> It enables positive and innovative outcomes that considers the interests of all parties involved;
>> A preventative process that allows individuals an opportunity to reach a suitable outcome without entering into a litigation process;
>> Our fees are relatively low and very affordable in comparison to litigation processes;
>> Agreements may be reached relatively quickly, aiming to reach sustainable outcomes. We write up agreements for individuals taking the hassle away.
What usually happens?
Individual assessment (1.5 hours per session):
The mediator meets with each disputing party individually, where they will be given information about the mediation process. Each party will be asked a series of questions that helps build a picture of the current situation and any relevant background information. With this information, the mediator makes a decision as to how the joint mediation sessions are conducted (see “How is mediation conducted?”). This also assists the mediator in assessing the appropriateness of mediation.
If mediation is suitable, then a mediation session is offered to all parties involved.
Mediation sessions (2.5 hours per session):
The mediator schedules a joint session, where all parties involved will be asked to attend. Parties are given an opportunity to share their individual perspective and concerns in a safe, structured environment. A discussion regarding each concern is encouraged, ideas and options are generated, and alternatives are considered, in the hopes of reaching a final agreement.
How is mediation conducted?
There are several approaches to how mediation sessions are conducted:
-
Joint: The parties are present in the same room with the mediator. Confidential separate sessions (caucus) are provided to assist with negotiations.
-
Shuttle: The parties are in different rooms of the building. The mediator “shuttles” information and parties’ statements back and forth between the parties.
It is ultimately the mediator’s decision as to how sessions are conducted.
Payment information
Payment
We ask that you pay at the end of each consultation, by cash, Bankcard, Mastercard or Visa Card. We are not a credit provider and cannot enter into arrangements that effectively involve provision of credit. This means your account must be paid before your next appointment.
Fees
Accredited Mediation Practitioner fees can range from $180 - $350/hr for a one hour consultation. We charge $120/ph/pp plus GST and room hire.
How many mediation sessions will be necessary to reach an agreement?
Each mediation is unique! Mediation is a process; hence, it may take a number of sessions (2.5 hours long each) to be able to achieve an outcome that is suitable to all parties. The number of sessions required depends on the complexities of the issues raised, the interaction between parties, and the amount of time that parties require to reach a suitable agreement. We offer sessions within several days of contacting our service, and close together; hence, mediation is usually a quicker service than litigation.
